How to Get a Stockton California Marijuana Business Permit

City of Stockton Accepting Applications for Marijuana Business Permits

In California, local governments have authority over the regulation of marijuana businesses. This means cities and counties are able to ban or allow the operation of marijuana businesses within their borders. Therefore, getting city approval is required before applying for a license with the state to become fully able to operate as a legal marijuana business.

On November 8th, 2016, the City of Stockton successfully placed Measure P on the ballot to overturn the ban on medical marijuana dispensaries and cultivation facilities. Measure P was approved by voters, and the City of Stockton now allows up to 4 medical cannabis dispensaries in specified commercial and industrial zones and allows up to 4 cultivation sites in industrial zones.

Both medical marijuana dispensaries and cultivation sites may not be permitted within

  • 1,000 feet of any other medical cannabis business,
  • 300 feet of any residential zone,
  • 600 feet of any child care center, religious facility, or drug treatment facility, or
  • 1,000 feet of any park or K-12 school.

Medical marijuana businesses must receive approval of a Use Permit through an application with the Community Development Department, which requires approval from the Planning Commission. Permits must also be approved by the Chief of Police, and must pass a background check.

The only two types of marijuana business permits currently available in Stockton are cultivation permits and dispensary permits.

Cultivation

There are four cultivation permits to be awarded. Those who own or operate a cultivation site may not own or operate any other cultivation site or dispensary. Cultivation sites may be up to 22,000 square feet and no more than two dispensaries are allowed to operate within the same City Council District.

Dispensary

Two dispensaries which were permitted before the ban are now allowed to operate again, leaving two dispensary permits to be awarded. Those who own or operate a dispensary may not own or operate any other dispensary site or cultivation site. No more than two dispensaries are allowed to operate within the same City Council District.
