Update: On May 24, 2019 the Missouri Department of Health and Senior Services (DHSS) announced that the final rules for the medical marijuana program were filed with the Missouri Secretary of State as emergency rules and as proposed rules. The final rules, which are eleven separate rules, are now posted on the DHSS website. The rules will go into effect on June 3, 2019, and will remain in effect until the proposed rules (which are the same rules as the emergency rules) and any changes based on public comment, are in effect.
The Missouri Department of Health and Senior Services (DHHS) released a draft of facility license application questions along with a rubric for how their applications will be scored. The DHHS has established ten advisory committees that will go over the specific application criteria.
The facility license application questions posted by the DHHS include, but are not limited to, the following planning:
- Business Plan
- Inventory Control
- Record Keeping
- Financial Plan
- Staffing Plan
- Security Plan
- Environmental Plan
In recent weeks, the DHHS also published several pages of draft rules to govern their medical marijuana program. The DHHS is seeking public feedback on their proposed rules and applications through early May 2019. Rules and applications for the medical marijuana program will not be finalized until June 4, 2019.
Key draft regulations that have been posted to the DHHS website include the following:
- General Provisions
- Qualified Patient / Primary Care Rules
- Medical Marijuana Establishments Generally
- Cultivation Facility
- Infused Products Manufacturing Facility
- Testing Facility
- Dispensary Facility
- Physician / Health Care Provider
It is extremely important to provide feedback during this draft phase of the Missouri medical marijuana program regulations. Each of the guidelines presented will shape the entire program, and how licensed medical marijuana businesses operate. You can submit feedback through a form provided by the DHHS.
