In order to legally open and operate a medical marijuana business in Pennsylvania, you must obtain a medical marijuana business permit from the state during an open application process.
On April 5, 2018, Pennsylvania opened Phase 2 of the application process for medical marijuana business licensing. Interested parties may apply for a dispensary permit or grower/processor permit until May 17, 2018. Read on to learn how to apply for a dispensary permit to open a medical marijuana dispensary in Pennsylvania.
Apply for a Pennsylvania Medical Marijuana Dispensary Permit
Up to 23 dispensary permits are to be issued during Phase 2. The issuing of dispensary permits will be divided among the six medical marijuana regions in Pennsylvania.
The number and locations of permits to be issued in each medical marijuana region during Phase 2 are the following
Region 1—The Southeast Region: 9 Dispensary Permits
Region 2—The Northeast Region: 3 Dispensary Permits
Region 3—The Southcentral Region: 3 Dispensary Permits
Region 4—The Northcentral Region: 2 Dispensary Permits
Region 5—The Southwest Region: 4 Dispensary Permits
Region 6—The Northwest Region: 2 Dispensary Permits
The application for a Pennsylvania Medical Marijuana Dispensary Permit requires the following financial commitments:
- Proof of funds of $150,000 must be deposited in applicant’s bank account.
- An initial nonrefundable application fee of $5,000.
- A fee of $30,000 for each location (up to 3 locations allowed per dispensary permit), must be submitted with the application and will be returned if the permit is not granted.
- An annual renewal fee of $5,000.

Applications are due by May 17, 2018. The Pennsylvania Department of Health will consider any application sent by mail to have been received on the date it is deposited in the mail as long as the United States Postal Service postmark on the outside of the package is clear and legible. The Department will return an application that is postmarked after the May 17, 2018 deadline.
